attorney signing guardianship paperworkIn the event that an individual has not executed a power of attorney, and she has reached the point of incapacity that she cannot conduct business for herself, a loved one may commence a guardianship in court to have the loved one declared the incapacitated person's guardian. 

Also known as an "Article 81" such an appointment can confer authority on a guardian to conduct various business endeavors, and also authority to make health care and personal decisions on behalf of the incapacitated person.
